Terms of service
These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for using the services provided by HIYAMAYA (hereinafter referred to as "the Company") on this website (hereinafter referred to as "the Service"). Registered users (hereinafter referred to as "Users") must use the Service in accordance with these Terms.
Article 1 (Applicability)
These Terms apply to all relationships between Users and the Company related to the use of the Service.
Article 2 (User Registration)
Registration is completed when a prospective user applies for registration according to the method prescribed by the Company and the Company approves it. The Company may refuse to approve a registration application if it determines that any of the following conditions are met and is not obligated to disclose the reasons for such refusal:
(1) The applicant has provided false information in their registration application.
(2) The application is from someone who has previously violated these Terms.
(3) The Company deems the registration inappropriate for any other reason.
Article 3 (Management of User ID and Password)
Users are responsible for managing their user ID and password for the Service. Under no circumstances may Users transfer or lend their user ID or password to third parties. The Company considers the use of a user ID to be by the registered User themselves if the combination of user ID and password matches the registration information.
Article 4 (Usage Fees and Payment Methods)
Users shall pay the usage fees for the Service as separately specified and displayed on the website by the method designated by the Company.
Article 5 (Prohibited Actions)
Users must not engage in the following actions when using the Service:
(1) Actions that violate laws or public morals.
(2) Criminal activities.
(3) Actions that damage or interfere with the Company’s server or network functions.
(4) Actions that may disrupt the operation of the Company’s services.
(5) Collecting or accumulating personal information about other Users.
(6) Impersonating other Users.
(7) Directly or indirectly providing benefits to anti-social forces in connection with the Company’s services.
(8) Any other actions deemed inappropriate by the Company.
Article 6 (Suspension of Service Provision)
The Company may suspend or interrupt all or part of the Service without prior notice to Users if any of the following circumstances occur:
(1) Maintenance or updates of the computer system related to the Service.
(2) Difficulties in providing the Service due to natural disasters, such as earthquakes, lightning, fires, power outages, or other major events.
(3) Interruption due to accidents involving computers or communication lines.
(4) Any other situation where the Company deems it difficult to provide the Service.
The Company will not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the Service, regardless of the reason.
Article 7 (Usage Restrictions and Cancellation of Registration)
The Company may restrict the use of all or part of the Service or cancel a User’s registration without prior notice in the following cases:
(1) Violation of any provision of these Terms.
(2) Discovery of false information in the registration details.
(3) Any other situation where the Company deems the use of the Service inappropriate.
The Company will not be liable for any damages caused to Users due to actions taken under this article.
Article 8 (Disclaimer)
The Company’s liability for non-performance is exempted except in cases of intentional misconduct or gross negligence. Even if the Company is liable for damages, the liability is limited to damages within the scope of normal occurrence and, in the case of paid services, within the amount equivalent to one month's service fee. The Company is not liable for any transactions, communications, or disputes between Users and other Users or third parties related to the Service.
Article 9 (Changes to Service Content)
The Company may change the content of the Service or discontinue the Service without notifying Users, and will not be liable for any damages caused to Users as a result.
Article 10 (Changes to Terms)
The Company may change these Terms at any time without notifying Users if deemed necessary.
Article 11 (Notification or Contact)
Notifications or communications between Users and the Company shall be made in the manner specified by the Company.
Article 12 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or pledge their status under the usage contract or rights or obligations under these Terms to third parties without the Company's prior written consent.
Article 13 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law. In the event of a dispute regarding the Service, the court having jurisdiction over the Company’s head office shall have exclusive jurisdiction.
